Advice often begins before a hearing.
A legal question may arise before anyone files a claim: what does a contract mean, which documents matter, and what options exist in a dispute? Legal advice helps a person understand the legal position and possible next steps.
If proceedings follow, an instructed lawyer can represent the client’s side. That differs from deciding the dispute. Section 3 of the Federal Lawyers’ Act expressly connects advice and representation; that pair of functions is the key to the test question.

The other three answers
All the listed roles concern law, but their functions differ.
a judge
Judges decide the case independently. They are not the personal legal representative of either party.
a lay judge
Lay judges sit on the judicial bench in specified criminal proceedings. They help decide the case rather than represent a client’s interests.
a prosecutor
Prosecutors investigate criminal matters and must also consider exonerating circumstances. That duty does not make them the accused person’s personal lawyer.
Advice, representation and compulsory representation are distinct questions.
The correct answer does not mean every court proceeding requires a lawyer. That depends on the court and procedure. For example, people may appear without a lawyer in first-instance labour proceedings.
A court filing office may help record certain applications. That differs from individual legal advice. The test asks for the profession combining advice with representation; it does not determine advice or costs in a particular case.
Section 3 · Federal Lawyers’ Act ↗Lawyer: advise + represent. Court: decide.
Notice the two verbs in the question. Explaining personal legal questions and acting for a client identify the lawyer’s role.
